TERMS & CONDITIONS


Definitions

“You” and “Client” refers to the participant of the both online and offline retreats, events or programs that Arabelle Yee International hosts. “AYI” refers to Arabelle Yee International (AYI) and its employees including Arabelle Yee. “Coaching” refers to any work that the Client does with AYI through online and offline retreat, events and/or programs. “Event” refers to any offline or online retreats, courses or workshops that AYI hosts. “Cancellation” is defined as not attending your scheduled event, including postponing or rescheduling.


1. Client - AYI Relationship 

You acknowledge that coaching is a comprehensive process that may involve different areas of your life, including work, finances, health, relationships, education and recreation. You agree that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively your responsibility. 

Client is solely responsible for creating and implementing your own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from working with AYI through both online and offline coaching, retreat, events and programs. As such, you agree that AYI is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by AYI. You understand that AYI does not prevent, cure or treat any mental disorder or medical disease. Any work that you do with AYI is not a replacement of what you are currently doing in terms of your emotional and physical wellbeing. 

You acknowledge that the coaching work you do with AYI does not involve the diagnosis or treatment of mental disorders and that this work is not to be used as a substitute for counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals. It is your exclusive responsibility to seek such independent professional guidance as needed. 

If you are currently under the care of a mental health professional, it is recommended that the you promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon with AYI.


2. Fees and Cancellations

By enrolling any online or offline retreat, events and/or programs that AYI offers, you agree to invest in the fees that was stated in the marketing materials including but not limited to social media posts, email, voice messages and on www.arabelleyee.com website at the time of the enrolment. 

If the fees are agreed to be paid in instalments, it is your responsibility to make all the payments prior to the agreed last date. 

All payments made are non-refundable. However, you may transfer to another course, program or retreat as credit should there be a reason for you to not be able to attend at the agreed intake. 


3. Limited Liability 

Except as expressly provided in this Agreement, AYI makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered.


4. Entire Agreement 

This document reflects the entire agreement between AYI and the Client, and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. 


5. Dispute Resolution 

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, AYI and Coach agree to attempt to mediate in good faith for up to (certain amount of time such as 30 days) after notice given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party. 


6. Severability 

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. 


7. Waiver 

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement. 


8. Applicable Law 

This Agreement shall be governed and construed in accordance with the laws of the State of Victoria, Australia, without giving effect to any conflicts of laws provisions. 


9. Personal Health, Medical Advice and Personal Responsibility

We do not cure, prescribe medications nor advice our clients to stop taking medications that are prescribed by their doctors. While many of our clients have experienced greater physical, emotional and mental wellbeing after attending our workshops, retreats or doing our programs, it is entirely the responsibility of each individual to consult with their doctors for medical advice and to take full responsibility of their physical, mental and emotional health.


10. Intellectual Property (IP)

All courses, content and publications created by AYI is our Intellectual Property and you agree to not disclose, download into your devices, distribute, copy or resell without our written consent. You may access to all the course materials and all the content as a student of our courses and programs, or as a client of AYI through out as long as you remain our student or client for your own personal learning and consumption. You agree that dishonouring this is breaking the international IP law, and we may take legal action against you.

By purchasing our online courses/programs, or attending our workshops/events, you agree to all these terms and conditions stated above.




Retreat Booking Policy

To secure your place in the retreat, payment must be paid in full. If the event commencement date is less than 30 days away, full payment is required to secure the booking. Failure to pay within this timeframe results in the deposit being forfeited and the place being resold unless otherwise agreed in writing.

If payment of the balance is not received by the due date, AYI reserves the right to cancel the reservation and retain the deposit.

The participant is responsible to pay for all extra services not included in the selected retreat package. 

If the participant leaves the Retreat prior to its conclusion, refunds will not be made for the unused portion of the Retreat. No refunds will be made for any excursion, meal, yoga class or other activity that the participant misses or decides not to participate in for any reason. 

Bank fees incurred by transferring money are the sole responsibility of the participant. All payments are non-refundable and non-transferable.


Retreat Cancellation 

It is your responsibility to read and understand our cancellation policy before making a reservation. We do not offer credit for a participant arriving to the retreat late or leaving early. 

All payments are non-refundable, however, may be transferable to another date of the event.

If AYI must cancel or reschedule a booked retreat date for any reason, you may transfer your full retreat payment to another retreat. AYI is not responsible for your expenses incurred in preparation for any cancelled retreat, such as airline tickets, loss of work, and/or other costs associated with preparing for your trip.

AYI reserves the right to change its location due to unforeseen issues (e.g. third-party delays or problems, construction, etc.). AYI will ensure the standard be kept the same in all the partnering villas/resorts.

If the retreat is cancelled or rescheduled to a different retreat date for any reason, excluding force majeure (see below) you may transfer your full payment to another retreat date within 12 months period, pending availability. Unexpected things do happen, so please purchase respective insurance once you have made your reservation.

AYI will not be liable for cancellation, failure of, or delay in performing it’s obligations under this agreement due to force majeure events such as earthquake, hurricane, typhoon, flooding, volcanic activity or other natural disasters, or in the case of war, action of foreign enemies, terrorist activities, labor dispute or strike, government sanction, blockage, embargo, epidemic, pandemic or if certain conditions present unacceptable danger to the participant.

In the event of a cancellation or rescheduling of the retreat, AYI will not be responsible for any currency fluctuations and will refund the original amount that was invoiced.

Travel and Other Insurance

Individuals are responsible for their own Personal, Medical and Travel Insurance. AYI highly recommends all participants protect themselves and their trip investment by purchasing an accredited Travel Insurance Protection Plan. Your Personal Travel Insurance should include trip cancellation insurance. Personal items, such as jackets, cameras, purses and daypacks are the sole responsibility of the owner. 




Disclaimer: Data Use and Protection

The customer agrees that he/she may be photographed and/or filmed during his/her stay and/or activities in connection with AYI, and also agrees that AYI may use such recordings for education and/or promotion and/or advertising purposes without any prior consent. Participants are deemed to have consented to AYI using such images and videos. However, if the participant prefers not to appear in any of the images/footage, they can inform AYI prior to the start of the retreat and AYI will ensure they are not included or blurred out in the images/footages.
